What Is Compassionate Surrogacy?

New York law does not recognize agreements between parents and surrogates as binding contracts. Although biological parents or the future adoptive parents cannot pay for the service of a surrogate or gestational carrier, they may pay for many pregnancy-related expenses. Many couples work directly with a fertility clinic to cover their surrogate’s medical expenses. In every case, it is wise to have a written agreement for everyone to follow, so expectations about the process are clear.

It is important to consult with a lawyer who is familiar with New York’s laws on surrogacy and assisted fertility before you begin the process. I will answer your many questions and help you understand what to expect.

When Adoption Is Necessary

If a surrogate is carrying your biological child, you may be able to obtain an order of parentage from the court, so that your names will be on the birth certificate. Unfortunately, courts do not always grant this order, which can be very frustrating for the biological parents. In these cases, the adoption process may be necessary.
